These Terms of Use (the “Terms”) apply to the SwissDock website (“SwissDock”) which are operated by SIB Swiss Institute of Bioinformatics (“SIB”, “we”, “us”). By accessing and using SwissDock and its functionality, you accept and agree to be bound by these Terms. If you do not accept these Terms, do not use SwissDock.

Please note that SIB reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms without notice at any time. Your continued use of SwissDock following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms, SIB grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use SwissDock.

Content

All text, graphics, user and visual interfaces, trademarks, logos, artwork and computer code (collectively “Content”) contained on SwissDock are owned, controlled or licensed by or to SIB and is protected by copyright, trademark and unfair competition laws. Except as expressly provided in these Terms, no part of SwissDock and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including "mirroring") to any other computer, server, web site or other medium for publication or distribution or for any commercial enterprise, without SIB’s express prior written consent.

Licensed Materials

Licensed Materials are made available under the CC-BY 4.0 Creative Commons 4.0 International License. This means that you can copy and redistribute in any medium or format, transform and build upon the material taken from Licensed Materials for any purpose, even commercially, provided you give appropriate credit, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests SIB endorses you or your use. You must not apply legal terms or technological measures that legally restrict others from doing anything the license permits.

License and restrictions

SIB grants to you a limited, non-exclusive, non-transferable, non-delegable, revocable, worldwide licence for the Permitted Use. For the purpose of these Terms, “Permitted Use” shall mean the use of SwissDock for the following purposes: (i) private study and (ii) internal research, whether on a commercial or non-commercial basis.

You warrant, represent and undertake: (i) not to use SwissDock in such a way that it can be damaged or overloaded ; (ii) not to copy or modify any portion of the Content and Licensed Materials in order to provide similar or identical services to SwissDock; (iii) to comply with all applicable laws, rules and regulations regarding the use of the Licensed Materials ; (iii) not to use any form of web crawler or other data retrieval tool or service to access SwissDock in any automated manner, including for the purpose of automatically collecting and reconstructing a Substantial Part of the Licensed Materials. For the purposes of these Terms, a “Substantial Part of the Licensed Materials” shall mean any subset of the Licensed Materials containing more than 20% of the Licensed Materials.

Suspension and termination of access

SIB may suspend, terminate, or prevent your use of SwissDock and/or access to the Licensed Materials, for any reason whatsoever and at any time without giving notice. Without limiting the generality of the foregoing, SIB may suspend, terminate or prevent your use of SwissDock and/or access to the Licensed Materials in the event that SIB reasonably believes you have failed to comply with any of these Terms.

Acknowledgement and citing rule

If you like to cite SwissDock or when you publish, patent or distribute results that were fully or partially based on Licensed Materials obtained from SwissDock, please cite the following reference papers:

SIB bears no responsibility for any direct, indirect incidental or consequential loss or damages, resulting from the use of SwissDock and Licensed Materials. SIB will make all reasonable effort to maintain continuity of SwissDock, but, however, we may temporarily suspend or discontinue the operation of its services in the case of maintenance, update, or in the event of force majeure, or when necessary. SIB attempts to notify you in advance of such temporary suspension or discontinuation; however, SIB bears no responsibility for the consequences of any temporary or permanent discontinuity of SwissDock.

Privacy Policy

Through its SIB Privacy Policy, SIB is committed to ensuring your privacy and the confidentiality of your personal data. When accessing and using SwissDock, SIB may collect personal information used exclusively for internal review, to improve the quality of our services and hardware infrastructure, and to also justify continued support of SwissDock. Governing Law and Jurisdiction

These Terms and any dispute or araising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with Swiss substantive law, without reference to its conflict of laws provisions. The competent courts in Lausanne, Switzerland, have exclusive jurisdiction.
